Overview
Nate Diehl serves as Senior Counsel in Trenam’s Litigation and Dispute Resolution Practice Group, where he focuses on business and commercial disputes. He has significant experience handling complex litigation from inception through trial. Nate has represented clients in matters involving construction litigation, suretyship matters, indemnity, construction contract drafting, professional liability claims, and complex commercial disputes. With extensive experience representing clients across various industries, he brings a strategic approach to dispute resolution that combines legal acumen with practical business insight.
Nate’s unique background includes an undergraduate degree in Construction Management, providing him with specialized technical knowledge that proves invaluable in construction-related litigation. During college, he gained hands-on industry experience working for a developer, general contractor, and construction manager on diverse projects including a billion-dollar airport renovation project, commercial office building, warehouse, and education campus. This practical construction experience, combined with his legal expertise, allows Nate to understand the technical complexities of construction disputes and effectively advocate for clients in both litigation and alternative dispute resolution proceedings.
In his spare time, Nate enjoys spending time with his family, golfing, and watching the Gators and Bearcats.
Representative Matters
Construction
- Represented an architect in several litigation matters involving allegations of professional liability and design defect on multi-million-dollar development construction projects. Successfully resolved each of the matters, limiting the client’s exposure to cost of defense.
- Represented an engineer in a contentious matter involving a large HVAC changeout project. Despite significant exposure as the engineer of record, convinced the Plaintiff to carve out a resolution with the engineer due to burden of proof issues.
- Prepared contracts for a surveyor tailored the client’s need for clear expectations involving billing and liens.
Suretyship and Indemnity
- Represented a surety in a program default of a busy contractor, which included several bonded public construction projects. Successfully resolved all issues including handling payment and performance bond claims, preparing and executing takeover agreements, and protecting bonded contract funds.
- Settled a probate bond claim by facilitating a resolution between the beneficiaries and the personal representative, which involved minimal contribution from our client and a full release.
- Obtained a successful result for a surety in a challenging performance bond litigation matter. Despite unfavorable facts, resolved the case at mediation by applying pressure through a motion for summary judgment targeted at the developer’s failure to comply with the bond’s conditions precedent.
- Successfully obtained, and collected on, a judgment in federal court on an indemnity agreement relating to losses associated with several construction projects that went awry.
- Successfully took control of and sold an indemnitor’s commercial property to recover losses incurred on surety bonded projects.
Commercial Litigation
- Successfully defended claims against the directors and officers of a defunct HVAC company, including claims of misappropriation of funds and breach of fiduciary duties.
- Recovered funds stolen from a company by employees who executed a fraudulent scheme of writing fraudulent checks and receiving kickback payments.
- Settled a claim from the trustee of a bankruptcy estate against the former owner of the company by exposing the dishonesty of the trustee’s key witness and clearly outlining the lack of sufficient proof.
